1. Prologue
By accessing or using the Riskclose, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any other legal agreements that may accompany the Service. Please read them carefully. If you do not agree to these Terms, you must not use the Service.Riskclose is an online trading rules monitor that enforces your trading rules by automatically closing trades and blocking new ones when your set rules are violated.

To use Riskclose, you must agree to these Terms. By doing so, you confirm that you are legally capable of forming a binding contract with Riskclose in accordance with your local legislation. If you are not of legal age or are otherwise prohibited from entering into such agreements, you must not use our Services.

We take your account security seriously. It is your responsibility to maintain the confidentiality of your Riskclose Account credentials. Do not share your login information with others, and take precautions to protect your account from unauthorized access.4. Registration

You are solely responsible for the activity that occurs on Your Account, and for keeping Your Account password secure. You may never use another person’s user account or registration information for the Services without permission.
4.3 Account Deletion
You must notify us immediately of any change in Your eligibility to use the Services (including any changes to or revocation of any licenses from state authorities), breach of security or unauthorized use of Your Account. You should never publish, distribute or post login information for Your Account. You shall have the ability to delete Your Account, either directly or through a request made to one of our employees or affiliates.

When adding a new trading account, you may be required to provide API keys/credentials to connect to third-party services through our platform. By entering these API keys/credentials, you grant us specific rights to enhance the functionality of the Application. It's advisable to review and understand the rights you're granting.
5.3 Handling of API Keys/Credentials
API keys/credentials are sensitive pieces of information. You must take measures to safeguard them and prevent unauthorized access. While Riskclose will handle your API keys/credentials in line with our Privacy Policy, we cannot be held liable for any losses resulting from sharing your API keys/credentials with third parties or if they are obtained through unauthorized means.

By using our Services, you agree not to engage in activities that disrupt, interfere with, or misuse our platform. 9.2 Payment Processing
Payment processing for our Services is facilitated by third-party payment processors. Any issues related to payment processing are beyond our control, and we are not responsible for them.
9.3 Membership Cancellation
If you choose to cancel your Riskclose subscription, your membership and access to paid services will also be terminated. Please note that payments for memberships are non-refundable.

Both you and Riskclose are responsible for any taxes that may apply to your income and activities related to the Services in accordance with your local tax laws.
10. Licenses
10.1 License from Riskclose
Riskclose grants you a limited, non-exclusive license to use our Services in accordance with these Terms. This license does not grant you ownership of our intellectual property.

By using our Services, you grant Riskclose a license to use your content to display on public profiles within our platform. You retain ownership of your content.
11. Availability of Content

we will no longer provide the Services to users in the country in which You reside or from which You use the Services; or

Upon such termination or suspension, You will not be entitled to any refund of unused fees for in-app purchases. You acknowledge that we are not responsible for interruption or suspension of the Services, regardless of the cause of the interruption or suspension.

You acknowledge and agree that you use Riskclose services at your own risk. Riskclose is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness or timeliness of the information provided through our platform and its uninterrupted or error-free operation and we are not responsible for any unavailability or failures caused by third-party services or events beyond our control. You accept that in the case of a disruption or error you may lose money. You assume full responsibility for the risks associated with your trading activities. The Riskclose is a tool to assist, not replace.
16.2 Limitation of Liability
Riskclose, its officers, directors, employees, and affiliates shall not be liable for any damages, whether direct, indirect, incidental, consequential, or otherwise, arising from:
Your use of our Services or reliance on information obtained through our platform.
The use or inability to use our Services, or any breach of warranty.
Any failure of performance, errors, interruptions, deletions, defects, delays, computer viruses, communication failures, theft, or unauthorized access.
Inaccurate or misleading content posted on our platform.
The conduct of any user, both online and offline.
Problems, failures, or technical malfunctions related to telephone networks, computer systems, servers, or providers, as well as issues with computer equipment or software.

If you engage in trading, you acknowledge the high level of risk involved. Riskclose warns that trading can lead to loss of investment and additional risks. Before trading, consider your investment objectives, experience level, and risk tolerance. Do not invest funds you cannot afford to lose. 17. Closing Conditions
17.1 Governing Law
These Terms and your relationship with Riskclose are governed by the laws of the Czech Republic.
17.2 Jurisdiction and Venue
You agree that any disputes arising from or related to these Terms will be subject to the jurisdiction of the Czech Republic. You waive any immunity from jurisdiction and agree not to commence proceedings in any other location. Alternative dispute resolution for consumer disputes may apply if you are a consumer.
17.3 Independence of Clauses
If any term of these Terms is found to be illegal or unenforceable, the validity and enforceability of the remaining terms shall remain intact. The unenforceable term shall be replaced with a valid and enforceable provision that aligns with the original intent.
17.4 Entire Agreement
These Terms constitute the entire legal agreement between you and Riskclose, governing your use of our Services. They replace any prior agreements or understandings between you and Riskclose regarding our Services.
